Terms & Conditions

1. Acceptance of Terms

By using Eleview’s products, services, software, and website (“Services”), you agree to these legally binding Terms and Conditions. If you do not accept them, you must not access or use the Services.

2. Definitions

  • “We”, “Us”, “Our” refers to Eleview Pty Ltd.

  • “You”, “Client”, “Customer” refers to the user of our Services.

  • “Content” means reviews, testimonials, images, videos, data, and any other material submitted or displayed.

3. Description of Services

Eleview offers:

  • Online review generation tools

  • Automated SMS and email campaigns

  • AI-generated social media content based on reviews

  • Dashboard reporting

  • Integration with third-party platforms (over 1,000 apps)

All Services are provided “as is” and may be updated, modified, or discontinued at any time.

4. Free Trials & Promotions

We may offer free trials at our discretion. Trials are time-limited and may revert to a paid subscription unless cancelled. No refunds are issued for charges incurred due to failure to cancel before the trial ends.

5. Client Responsibilities

You agree to:

  • Use the Services only for lawful purposes

  • Obtain customer consent before sending review requests via SMS or email (in line with the Spam Act 2003 and Privacy Act 1988)

  • Not use Eleview to send spam or misleading content

  • Comply with all Australian Consumer Law obligations

  • Accurately represent your business and not use reviews in a deceptive or misleading way

6. SMS Campaigns

By using our SMS tools, you confirm you have obtained valid consent from all recipients. You are solely responsible for compliance with the Telecommunications Act 1997 (Cth), Spam Regulations 2021, and any carrier-specific rules. Eleview is not liable for SMS delivery delays or filtering.

7. AI-Generated & Automated Content

Our AI tools may create captions, graphics, and layouts based on customer reviews. While we strive for accuracy and appropriateness, we are not liable for errors, misrepresentations, or unintended messages generated through AI features. You must review all auto-posted content for accuracy and compliance.

8. Third-Party Integrations

Our platform integrates with over 1,000 third-party applications. You acknowledge that these third parties have their own terms of service and privacy policies. We are not responsible for failures, breaches, or changes in these external systems.

9. Intellectual Property

Eleview retains all intellectual property rights in its platform, software, designs, logos, and content (except for customer-generated content). You grant us a non-exclusive, royalty-free license to use your business name, logo, and reviews for the purposes of delivering and marketing our Services.

10. Payment, Billing & Invoicing

  • All charges are in AUD and may include GST.

  • Invoices must be paid within the agreed terms.

  • Subscriptions auto-renew unless cancelled.

  • Failure to pay may result in account suspension or termination.

If using Stripe or another processor, you agree to their terms. We do not store your payment information directly.

11. Cancellations & Refunds

You may cancel anytime via your Eleview dashboard or by written notice.

  • No refunds are given for partial months or unused periods.

  • ACL guarantees apply in cases of major faults or misleading conduct.

12. Suspension or Termination

We may suspend or terminate access if you:

  • Violate these terms or applicable laws

  • Use the platform in a harmful, fraudulent, or deceptive way

  • Fail to pay fees due

In serious cases, legal action may be pursued.

13. Dispute Resolution

Before starting legal proceedings, you agree to first attempt to resolve any dispute through good faith negotiation. If unresolved, disputes will be handled in the courts of Victoria, Australia, in accordance with local laws.

14. Warranties & Disclaimers

We do not guarantee uninterrupted service or that all features will always be available. To the extent allowed by law, we exclude all implied warranties except those required by the Australian Consumer Law.

15. Limitation of Liability

To the fullest extent permitted by law, our liability is limited to the resupply of the Services or the cost of such resupply. We are not liable for loss of data, loss of profit, or indirect/consequential loss, unless required by law.

16. Indemnity

You agree to indemnify and hold Eleview harmless from any claims, costs, or damages (including legal fees) resulting from:

  • Your misuse of the Services

  • Breaches of these terms

  • Violations of Australian laws (including privacy, spam, or consumer laws)

17. Changes to Terms

We may modify these Terms at any time. Updated versions will be posted on our website. Continued use of the Services means you accept the changes.

18. Severability

If any provision of these Terms is found to be unenforceable, the rest remain in effect.

19. Entire Agreement

These Terms constitute the entire agreement between you and Eleview and supersede all previous agreements or representations.
